NOTICE: Warning Concerning Copyright Restrictions
The copyright law of the United States (Title 17, United States Code) governs the making of copies or other reproductions of copyrighted material.
Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.
This institution reserves the right to refuse to accept a copying order, if, in its judgment, fulfillment of the order would involve violation of copyright law.
Reproductions
In accordance with United States copyright law, many items in Special Collections and University Archives (SCUA) collections can be reproduced for research purposes and other uses.
The reproduction of SCUA materials is allowed, considering condition, format, size, and other considerations. SCUA and/or Preservation staff may evaluate the materials to be reproduced and render a decision on their reproduction. Preservation concerns will supersede all other considerations.
All SCUA materials are non-circulating and will not be loaned to researchers for reproduction. SCUA materials may, however, be sent to third-party vendors for reproduction if the Library's resources prevent reproduction in-house.
Researchers can create reproductions of SCUA materials in accordance with this policy and United State Copyright Law using their personal cameras, cellphones, or the walk-up overhead scanner in SCUA's reading room. Personal scanners are not allowed. Researchers are not allowed to use other SCUA equipment to create reproductions.
To obtain reproductions produced by SCUA staff, researchers must complete the appropriate request form and payment for the order.
- Image reproduction requests require the completion of the Request for Reproduced Images form
- Document reproduction requests from books, manuscripts, and archives require the completion of the Request for Photocopies form.
- Audiovisual reproduction requests require the completion of the Audiovisual Reproductions Order Form.
All materials will be delivered digitally and may be available to download for a limited period of time noted during delivery. Reproduced materials may be delivered in another format or manner if the researcher and SCUA staff have agreed verbally or in writing. This may require researchers to provide their own CD or USB drive or for SCUA to provide a CD for a fee. Additional fees may apply for delivering reproduced materials in a format or manner other than digitally via a link to SCUA's cloud storage platform.
SCUA staff reserves the right to limit the size of reproduction orders. Generally, no more than 10% of a collection may be copied, and orders over 100 pages may be split into multiple orders (with separate payment required for each order).
Payment for reproduction and use fees can be made by check or credit card (Visa, Mastercard, Discover, American Express).
Use
Patrons must have permission from Special Collections and University Archives before using reproduced materials in any manner aside from private study, scholarship, or research. The researcher assumes all responsibility for obtaining the appropriate copyright permission. Proof of copyright clearance must be provided by the requester to SCUA for any materials whose copyright Iowa State University does not control. Use of any part of these materials in any audiovisual project, making copies, and/or uploading to the Internet without the written consent of SCUA is prohibited. Permission for the reproduction of materials is on a one-time only, non-exclusive basis. Researchers are required to complete a Request to Publish form and pay all fees before using any item for publication, including in social media, website, presentation, etc. The proper credit line will be provided to the researcher, and its use is required in all publications.
